Progress packaging GmbH attaches great importance to the protection and legally compliant collection, processing and use of your data as well as the protection of your privacy. We have taken technical and organisational measures to protect your data from manipulation, loss, destruction or access by unauthorised persons in order to ensure the confidentiality of your data within the framework of the applicable provisions of data protection law.
In the following we inform you about the processing of your personal data by progress packaging GmbH and the rights to which you are entitled under data protection law.

2.1 We process your personal data in compliance with the provisions of the DSGVO, the Federal Data Protection Act (BDSG) and all other relevant laws.
2.2 As part of the initiation or execution of the contract, we collect the personal data that you make available to us via a contact form, by telephone, e-mail or post or by other means. The processed categories include in particular contact data (e.g. first name, surname, address, telephone number, e-mail address), contract data (e.g. contact data of contact persons, contract contents, bank details) as well as the date and reason for establishing contact, if applicable.
2.3 As a rule, your personal data will be collected directly from you during the initiation or execution of the contract. In addition, we also process personal data obtained from other companies or other third parties (e.g. credit bureaus) as well as personal data that we have obtained from publicly accessible sources (e.g. commercial register, Internet, etc.).
2.4 The primary purpose of data processing is to establish or fulfil a contractual relationship with you, i.e. the provision of goods or other services and related activities. The primary legal basis for this is Art. 6 para. 1 b) DSGVO. In addition, your separate consent pursuant to Art. 6 Para. 1 a), 7 DSGVO may also be used as a data protection permission provision. We also process your data in order to be able to fulfil our legal obligations, in particular in the area of commercial and tax law. This is done on the basis of Art. 6 para. 1 c) DSGVO. Where necessary, we also process your data on the basis of Art. 6 para. 1 f) DSGVO in order to protect legitimate interests of ourselves or third parties (e.g. authorities).
2.5 If we collect your email address, it may subsequently be used by us to send you a newsletter. In such a case, only direct advertising for our own similar goods or services will be sent via the newsletter. The legal basis for the dispatch of the newsletter as a result of the purchase of goods or the use of services is § 7 para. 3 UWG or Art. 6 para. 1f) DSGVO.
2.6 Should we wish to process your personal data for a purpose not mentioned above, we will inform you of this beforehand.
2.7 You are not obliged to provide the aforementioned personal data. However, the data provided may be necessary for the establishment and performance of a contractual relationship and the fulfilment of the associated contractual obligations. Without the provision of the data, we may not be able to communicate with you and conclude or execute the contract.
3.1 Within our company, only those persons and bodies will receive your personal data that they need to fulfil our contractual and legal obligations or in the context of processing and implementing our legitimate interest. In addition, your data will be transferred within our group of companies to certain companies that perform central data processing tasks (e.g. marketing, IT support). We have entered into appropriate contract processing agreements with these companies to ensure that they comply with data protection legislation.
3.2 We will only pass on your personal data to third parties if you have given your express consent in accordance with Art. 6 Para. 1 a) DSGVO, if we are legally obliged to do so in accordance with Art. 6 Para. 1 c) DSGVO (e.g. tax authorities) and if this is legally permissible and in accordance with Art. 6 Para. 1 a) DSGVO. 1 b) DSGVO is necessary for the execution of the contractual relationship with you (e.g. logistics service provider, commercial credit insurance) or there is a legitimate interest pursuant to Art. 6 para. 1 f) DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data (e.g. credit agencies, courts, lawyers).
3.3 We do not currently intend to transfer your personal data to a third country or an international organisation. If we transfer personal data to service providers or companies outside the European Economic Area (EEA), the transfer will only take place if the third country has been confirmed by the EU Commission to have an adequate level of data protection or if other appropriate data protection guarantees (e.g. binding internal company data protection regulations or EU standard contract clauses) are in place.
4. Duration of storage
4.1 We will delete your personal data as soon as it is no longer required for the above purposes. For the personal data provided, this is usually the case when the business relationship with you has ended. Insofar as the communicated data are subject to the tax and commercial retention obligations, they will be stored for the duration of the retention obligations of up to ten years. In addition, it may happen that personal data is stored for the time required for the assertion, exercise or defence of legal claims (statutory limitation period of three or up to thirty years).
5.1 You have the right, pursuant to Art. 15 DSGVO, to request information about your personal data processed by us. In particular, you may request information on the processing purposes, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of rectification, deletion, restriction of processing or objection, the existence of a right of complaint, the origin of your data, unless it has been collected from us, as well as the existence of an automated decision-making process including profiling and, if applicable, meaningful information on its details.
5.2 In accordance with Art. 16 DSGVO, you may immediately request the correction of incorrect or incomplete personal data stored by us. You have the right, pursuant to Art. 17 DSGVO, to request the deletion of your personal data stored by us, unless processing is necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims.
5.3 Pursuant to Art. 18 DSGVO, you have the right to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing pursuant to Art. 21 DSGVO.
5.4 You have the right, pursuant to Art. 20 DSGVO, to receive your personal data which you have provided to us in a structured, common and machine-readable format or to request transmission to another responsible party.
5.5 Pursuant to Art. 7 para. 3 DSGVO, you have the right to revoke your consent to us at any time. As a result, we may no longer continue the data processing based on this consent in the future.
5.6 You have the right to object to the processing of your personal data for direct marketing purposes without stating any reasons. If we process your data to safeguard legitimate interests, you may object to such processing for reasons arising from your particular situation. We will then no longer process your personal data unless we can prove compelling reasons for processing worthy of protection which outweigh your interests, rights and freedoms or the processing serves the assertion, exercise or defence of legal claims.
